I have a 3 year old daughter and a 1 month old with my ex boyfriend. We live together in a house but just as roommates. He has custody of our daughter and wants to file custody for our son. I willingly gave up our daughter for financial purposes but I am ready to fight for both of my children. Once I fight, Dad will kick me out of his house, I am not on his lease. People are telling me to gather information and wait until he files, then fight for my children. The man is very manipulative and I am naive enough to let him control me. I don't want to lose this battle once it starts. If he files and I fight, who gets our son for the time being? And if the father makes more than I do but isn't suited to take care of the children, does that mean he gets them over me? He has a history of alcohol use and he has struck our daughter to the result of her bleeding. He doesn't have a vehicle(he uses mine right now) and he works nights. How much of a chance do I have?

You are in a very delicate situation, and if what you say is true, your children are in a very dangerous situation. You need to hire a lawyer today to plan your escape from this situation. If you keep waiting around for him to make the first move, your children will continue to suffer.

Your story is good. But, you have to prove all of these things. Takes time and money. Depends on how good your lawyer is. Good Luck.
