child custody

my 13 year old stepson has lived with his father and I for over a year. We are wanting to obtain primary custody and discontinue child support and need advice on what we need to do. We are limited on funds.

Re: child custody

Your husband needs to file a modification action seeking a change of custody. Since the child is old enough to sign a choice affidavit and there has been a voluntary relinquishment for over a year, you can probably obtain a fairly quick temporary order changing custody and ceasing the current child support payments.
