Legal Question in Family Law in Texas
child custody at 16 years old, child wants to live in texas
The father has had custody of child since birth, the child is 16 and demands to live with mom,at 14 the father gives chid to mother and mother returns child under false pretenses(visitation). Father has made it clear, when he went to mother there was no return. The child stayed for 2 years and was returned because of a live in boyfriend. We are very firm in our decission to send child back, but fear child abandoment laws. We were under the impression the child was old enough to say, the mother agreed, no paper work was ever requested for 2 years, and we feel very manipulated. The child is 16 the mother has never paid support, we were all in agreement this was her turn to take responsibility for her son. A boyfriend comes along, and the boy is returned under false pretences. What can we do,and does she after 2 years, have some kind of obligation of custody to her son,and if we return him and relinquish rights to natural mother, does she have to take him? What steps need to be taken?

Re: child custody at 16 years old, child wants to live in texas
A Texas judge is not going to allow you to terminate your parental obligations to support and care for this child until the age of 18.
Under the standing order, according to you, you have the legal responsibility to provide all of the needs of this child.
If you want to change that, you will have to file a modification in the court that has jurisdiction.
Apparently this child is in everyone's way. What a shame for this child.
