child custody
I have custody of a 5 yr old child that the mother gave me 4 years ago. recently found the father in prison what can I do about adopting since he is not scheduled for release till 2014. I have already adopted the sister by a different dad and I want them to have the same last name...

When you say you have custody, I hope you have an order of the court granting you custody. The mother can't give you custody other than with an order of the court. As far as adopting, that may be difficult. The father's rights have to be terminated; and he may or may not be willing to do that. I advise you to see a lawyer if this is important to you. It's a little too complex to go into with this response.
