No. Assuming there is a custody action before the Court, a child over the age of 12 can sign a "Preference" indicating which parent he or she would like to live with and have it filed with the Court. The "Preference" would then become part of the facts the Judge would consider in deciding who the child should live with.

A child over the age of 12 can sign a statement of preference concerning which parent he/she wants to live with but it is not binding on the judge. The older the child is, the more weight the judge will place on the child's statement of preference. I suggest you hire a lawyer to assist you.
