Legal Question in Family Law in Texas

child custody/child support

My husband has a daughter living in Texas with her mother. We are in California. The divorce and child support was filed in California. The mother has left and the child is now living with an older sibling who is not a legal gardian. Does the child support still have to be paid and to whom.

Your husband has to go forward and file an OSC to modify the underlying child support order, otherwise the underlying order remains in full force and effect. Both parents have an obligation to support the child!

I suggest that your husband consult with an experienced family law lawyer, and take a copy of the underlying orders with him. Experience is not expensive, it's priceless!
