Legal Question in Family Law in Texas

Child custody/kidnapping

Is there a statute of limitations on kidnapping by a non-custodial grandparent? The child was taken from Texas to New Mexico.

Re: Child custody/kidnapping

What an odd question. You can look up all criminal statutes of repose in WA on line under Title 9, Crimes and Punishments in WA.

It doesn't matter if there is a family relationship between the kidnapper and the victim - kidnapping is kidnapping.

It matters that the child was taken out of his or her home state. That gives the federal jurisdiction and your police department would likely contact the FBI for assistance.

There are also interstate compacts (agreements) about child custody - one state will give full faith and credit to another state's custody orders. If there is no custody order, then where are the child's parents?

What are they waiting for?

What is confounding about your question is why in the world would you wait ANY period of time to get the police involved and get the child back?
