Child custody/no visit with other child
My brother is currently attempting to get custody of his 4yr old child due to the mother's alcohol and drug abuse. However, he also has a 6yr old from another woman and by choice, he does not visit this child (he does pay support).
Is her lawyer allowed to mention the situation with the older child being that it has no bearing on the welfare of the 4yr old? And if so would a judge take that into account with this custody case?

His relationship with his other child is relevant evidence in a custody case. The judge considers many factors in determining what is in the best interest of the child, and this is one of those factors.
