Legal Question in Family Law in Texas

child custody/visitation

I am in the process of divorce. We both have lawyers and a court date was set for temperary orders, however his lawyer has yet to be able to make it to court. My petition state joint custody and conservatorship of our daughter with myself as the costodial parent. My husband had my daughter from 8am friday morning to 11am sunday morning and now wants her at 5pm monday night until 5 pm on thursday. I beleive he is trying to establish a routine of her living with him for one week and with me for one week. Can the court make custody in this manner and do I need to let her go to his house before we have a court order?

Since you are represented by counsel, I can't give you legal advice. Ask your attorney about this and why don't you have temporary orders. Ask him/her what you're supposed to do without temporary orders.
