My friends ex husband who was abusive to her, has custudy of their 17 year old son. He is now abusive to the son. He wants to leave and live with his mother. Will she have to go back to court or is the child old enough to make that decision on his own and just leave?

In all probability, she is going to have to file a modification action seeking custody of her child, and that is the only safe thing to do unless you trust your ex to agreeably turn over the child and not to seek his return at a later time. She needs to go to court and change custody.

He is not an adult until he is 18.

I know that CPS usually won't get involved in a 17 yr. old leaving home in the Houston area.

She needs to talk to an experienced family law attorney in the county where the case occurred.
