Legal Question in Family Law in Texas

Child emancipated, arrears still owed after 2 years?

157.264(b)(1)-Applies to us.I would like to know what will happen when the 2 yrs is up and some arrears are still owed if we are being garnished. No. 2 does not apply since we are being garnished, right? Also 157.262. Could you explain that? (a)may not reduce arrearages, but (e) says it can. also (2)we havent seen kid in 6yrs. Any bearing at all? Does person seeking assistance get all the say so in reducing arrearages? Also seen in 231.002 (i)? And, if we paid directly to mother, mother reported to state, state gave exact credits but didnt credit any intrest over a 5 yr period, can we be credited back the interest after a judgement? What's the best course of action to getting credited the right amount of 12%annual accruing interest? Can you take a judgement back to court after 3 yrs? If so please email your contact info as I will need an attorney.

Yes, you do need an attorney. It seems like you have done some good research, but be careful - those statutes you are citing must also be read in conjunction with the other chapters dealing with child support.

If your case is being handled through the TX Attorney General, you need an attorney in that location that has some experience working with that office.

If it's a private case, your best avenue is to write out a one or two page summary of your case and the remaining issues, call some lawyers in the county the case is in, setup a consultation, and take your written questions with you.
