Child Home Alone

My son is on summer visitation with his father approx. 6 hours from where I live. I found out that his father is leaving him home alone during the day while he works. His shift is 12pm-9pm. My son just turned 8. It is my understanding that there is no law against this. However, I know that my son is not mature enough to be left alone for this amount of time. According to the visitation agreement, he is supposed to be there for 42 days this summer. Do I face any legal consequences if I drive to pick my son up while his dad is at work?

He could file contempt on you.

You can always call the police and ask them to go by one afternoon for a "good and welfare" visit.

See if they will get involved.

CPS is usually slow, so I don't recommend them -- except as a last resort.

I would urge you to hire an attorney & get your visitation orders changed.

You neeed "proof" that this is happening. The kid's testimony is NOT enough.
