Legal Question in Family Law in Texas
If a child was not LEGALLY (by CPS) taken away from a parent, but has been being cared for by a relative and there is no paperwork filed within the court system can that relative keep the child from their biological parent? Father went into rehab and his sister was to care for the child until he got better and got on his feet, which he has done, but the sister is now trying to control every aspect and demanding the father pay child support but is not allowing sufficient visitation between the father and child due to her own personal opinions of the childs psychological well being.

The only people who can lawfully possess a child without a court order are the parents.
