Legal Question in Family Law in Texas

Child out of our Marriage

My husband is being accused of fathering a child from another woman. They were once co-workers at a military installation working Civil Service. He was a supervisor. Since this woman has gotten pregnant she has continuesly bad mouthed my husband at work and now his ex-employees have no respect for him. She has also threatened to put him in jail if he does not pay Child Support. Can legal action be taken against this woman?

If what she says is true, the answer is no. Freedom of speech allows us to speak the truth and some harmless untruths. When the child is born, your husband can ask for a paternity test ASAP to determine the truth of the accusations. Right now, he could seek a Temporary Restraining Order and a Temporary Injunction to keep her from talking about who is the father until it is proven by blood testing. Good Luck.
