Legal Question in Family Law in Texas
I need help on a child modification. I'm a father with joint-custody and the child lives with me. Mom has missed all Thursday visits since 2013 and never sticks to the 1st,3rd and 5th weekend schedule. I usually let her see him when she can. However I recently got married and she has been causing chaos for my wife. I work quite a bit an my wife is usually the one who packs bag and has our son ready to leave for visits. She has asked my wife to have sexual intercourse, tried to convince my wife that I want to have intercourse with her as well and has even threated my wife, called her out her name which has made it difficult for my wife being the one who delivers the child. What should I do with the information I have on begging the modification process. I don't want things to blow up in my face.

If the child lives with Dad, Mom does not have to visit the child. For noncustodial parents, visitation is an option, not an obligation. Child support, however, must be paid. Mom must also give 24hrs notice if she is not going to pick up the child. You can agree on anything you want to agree on. However if you can't reach an agreement you need to go by the decree. If she fails to follow the decree, you have grounds for enforcement which usually results in a motion to modify. Is the child around when Mom propositions your wife?
