Child Paternity
I was legally married, but separated, and had a child by another man. When the child was born he was given my married last name. The hospital said that we would have to all sign an Acknowledement of Paternity form in order for the biological father to be named on the birth certificate and to correct the child's last name. My divorce was final last month and states that this child isn't my ex-husband's. My ex-husband has been incarcerated for the last four years and is unable to sign the AOP. He will be incarcerated for another four years.
I called the Attorney General and they said I would need to contact an attorney. What do I need to do to add the child's biological father to his birth certificate and have the child's last name changed? The biological father isn't denying paternity.
