Child Protective Services
If there is no abuse of any kind involving a child, does CPS have the right to claim that there will be in the future or take the child away from the mother before going to court without court orders?

CPS can pretty much do what they want if they think they have justification. Get yourself a good family law attorney that handles CPS cases.
