Legal Question in Family Law in Texas

My son is in prison, will get out in September '09. His baby's mother is in jail, for what I don't know. I haven't seen her since December '07. My grandchild's other grandmother has been taking care of her since Dec. '07. I get my grandchild every other weekend, this started in the middle of '08. I take my grandchild to see her daddy everytime I get her. My grandchild is 2 1/2 years old. The question is when my grandchild's mom gets out of jail she wants to take my grandchild to Columbia to see her grandfather before he gets very ill and my grandchild's other grandmother would like for her to stay with her dad for awhile so she doesn't go back to hanging around the old gang. What are my son's rights? I know he doesn't want his daughter to go to Columbia. What can I do as a grandmother? Hopefully they won't try to do anything illegal to get my granddaughter a passport.

If your son is in prison, then you have legal standing to bring a lawsuit.

Most courts in Texas don't like kids leaving the country - especially when they are so small.

It is not illegal for a mother to get a passport for the kid.

I highly recommend that you hire an experienced family law attorney to help you.
