Child seperation

My 16 yr old cousin wants to leave his home with his father and move back with his mother. His father has legal custody..what rights does he has?

Your cousin's mom needs to go back to court and file a Motion to Modify SAPCR and include a statement of preference from your cousin. She will need a lawyer.

Children do not really have any rights, not even teenagers. Your cousin is old enough to express his opinion, but it is still the Judge who decides who he lives with. There might be an option beside filing a modification, it depends on the parents. Your cousin's mother needs to talk to a good family law attorney.
