child suport

my ex husband has never paid child suport and i was wondering since it has been about 18 years if there is any way to get it, me or my son

Yes, if your divorce was done in Indiana, you can collect for up to 10 years after the child's 18th birthday or up to 10 years after the child's emancipation, whichever occurs first.

I do not know what the laws state in Texas.

If the divorce was done here, you would still go through the Indiana courts, even though you might live in another state now.

In Texas, you would be able to file a motion for enforcement of the support obligation to recover back unpaid support. If you were to file such an instrument, you could receive an award for all back support and accrued interest. Realistically, though, in many counties the court may penalize you for not seeking enforcement sooner; though the court should still award you a sum for the amount owed. Also, as in many cases I have been involved with, a motion for enforcement may not be answered by the Respondent, in which case a default may be taken -- this can include attorneys fees and more.
