Child Support Case - Do I need an attorney?
I am the custodial parent of two and live in Lee County, Florida. The non-custodial parent lives in Bexar County, Texas. He is $70k in arrears in paying child support. In Aug. 2000, a Bexar County judge ordered that he pay the previously ordered $400 p/m plus $1000 p/m towards the outstanding balance. The order stated that in lieu of paying $39k in a bulk payment, he would be under a 72 month probation. Should he stop making payments, the probation would be revoked and he would go to jail.
Payments have stopped and for the last 4 months I've heard that there is another hearing ''pending''. The OAG will not talk to me directly, but refer me to my Florida agency for information updates. Florida does request information from Texas!!
Would it be better for me to eliminate Florida and hire an attorney in San Antonio to represent me? Would the OAG then be able to release information directly to me or my attorney? What is the normal procedure when a court order has been violated?
