Legal Question in Family Law in Texas

child support

can someone be charged with more child support if they have paid off loans through their bank? support is due to increase $150 after the first of the year anyway. is this money that has now not being used to pay debts capable of being taken for child support?

Re: child support

The answsers to your questions are "yes" and "not exactly." If you are having to pay less on a debt, your "net resources," or in other words, the figure used to calculate child support, will increase. If you are supposed to increase child support by $150 after the first of the year, the new net resources figure may or may not result in a change of child support. Nothing will change that is not provided for in the current order unless and until that order is changed.

Re: child support

Child support is calculated as a percentage of "net resources". This number is based upon income, not debts - unless there was some provision in the divorce decree. But, usually, child support is not related to payment of debts.
