Child Support from current Husband

My boyfriend who is seperated from his wife in Texas and wanting to file for a Divorce. He has been residing in Ca. since 2006. Which now he is currently on Parole in Ca. He recieved a letter stating he has to appear for a hearing for child support in Tx. in March. Can his wife seek child support for their 2 small children if they are still currently married and no court documents have been filed by either party for a Dissolution of Marriage??? While she doesn't even allow him to speak to his children and he calls on a daily basis.

It is hard to say, without more information. It is likely that documents have been filed, either by the AG or a private attorney. He needs more information.
