child support and custody

my husband wants to know if he can fight a child support order if the mother of the child refuses to give the child my husbands last name and if he has to pay any backpay to her if he dicides to fight for custody

Practically and legally speaking, child support and custody are separate and distinct issues. He may have a child support arrearage, whether he fights for custody or not. The issue of the child's last name is also unrelated to the child support, and is an issue to be addressed to the court.
