Child Support

I have custody of my son and my ex is trying to take my rights away. If he was to get custody would my current husband have to pay child support since I don't work?

Child support is your obligation. You would be required to pay child support at no less than the minimum wage. That calculates to be about $165-$175 per month. The child support could be higher depending upon other possible factors.

Child support is the obligation of the parent, not his or her spouse. If you are not working, you may be required to pay child support based upon your earning capacity, NOT your actual earnings, if any. For example, if you used to be a doctor, your support would likely be higher than if you had been a librarian.

Call an attorney in your local area if you have questions. A custody battle is not something that you would want to undertake on your own.
