Legal Question in Family Law in Texas

Child support for daughter over 18

I have legal custody of my daughter who turned 18 on 4/3/03. At 18 she quit school and moved in with her boyfriend. Boyfriend is now in jail. If she moves in with her mother and goes back to school, will I be liable to pay child support?

Re: Child support for daughter over 18

Most decrees state in general terms that child support is payable until 18, and after 18 if the child is enrolled in high school.

In this case, the child is still enrolled in high school (I am not sure what age Bell and Trinity allow students), but the child had quit school at one point after reaching 18. Since you had custody, it is up to the mother to actually bring suit for a modification. I would probably make her do so.
