Legal Question in Family Law in Texas

Child support

My daughters father and I recently agreeded on a court order 12-4-08, from which he was ordered to pay 436 on child support. He just filed for a motion for a new trial on the grounds that the payments were not explained to him and it claims more than %50 of his income, making it unlikey for him to live on the remaining amount.

I thought they OAG bases the child support of the gross income, verified by the pay check stub brought in? How does this whole process work?

What evidence will he need to support his argument?

How often is a motion like this granted?

How likely is it that they will change the amount?
