i want to get a divorce my ex husband and i have agreements on financial help for our son and we dont want to file child support through court do we have to

It is rare, but not impossible.

You would have to present a compelling situation to the judge establishing that the child's entire future welfare has been provided for -- since the child support is not for you, but for the child.
