Legal Question in Family Law in Texas
Child Support enforcement
I got stuck with the ''propensity to earn'' crap. Since then, I've been trying to stay afloat with my business, but the recession is really bogging me down. So, I got behind on my child support by 2 payments and my arreage by 10 payments. I had talked with the Attrn Gen, and they kept telling me, just keep paying the child support. Well, the second I got two payments behind, my ex appears to be attempting to serve me. Within 30 days of the 3rd month, I have paid her 100% of all payments due, (but still have my arreage balance although all past due payments have been caught up). I have tried to sell my house, tried to refinance the house, but are upside down by about 50grand. My question is: Since I'm out of town all the time, getting served is almost impossible. What happens if I don't get served? Why won't the adverse attrny drop the case? My wife called him and told him to stop haveing the people harras her children and that the amount due was paid.
I've noticed several TX lawyers on this board. I'd like to hire an attrny, but the $1,500 paid to an attrny got used against me last time and I was incarcerated for 4 months. My ex didnt even call me to ask what the problem was. She refused to talk to me. Please Help!

Re: Child Support enforcement
You need to hire a local attorney to file a motion to modify to reduce your child support. The only way child support will be reduced is if a court changes it.
