Legal Question in Family Law in Texas
child support
Is my ex-wife entitled to part of my tax return monies, if I am remarried & have filed jointly with my new wife?
We have been divorced for nearly 2 years & she's claiming change of status & wanting to pursue more child support.
She's requesting info about bank statements & accounts/savings on myself~ but again, my new wife's information is included in mine. Nothing concerning my net income has changed since divorce~ so my child support should stay the same~what is the basis for needing all this other info. now? Is any information private? How much info is considered illegal for her to request & view?

Re: child support
Based on what you have written, it would appear that your ex-spouse has filed a modification with the court. The courts allow for discovery of your financial information so that an accurate view of your financial situation may be made to calculate child support. You should seek assistance from a local family law firm to ensure that your rights and interest are fully protected. If my local family law firm can assist you with this legal issue or any other legal matter, please contact my paralegal Tina ([email protected]) to arrange for an initial consultation.
Re: child support
If she has filed a Modification and sent you discovery requests, she has a right to the information. In fact, in Harris County she has the right to see current pay stubs, health insurance information, and income tax returns just because this is a suit involving children. You really need to talk to a good family law attorney. If you had an attorney, he or she would know what you had to produce and what you didn't and would know the rules about modifications.
