Legal Question in Family Law in Texas
Child Support and gifts/severence pay.
My understanding is that gifts and severence pay can be used in the calculations for child support. My ex received a gift of around ten thousand dollars from his new in-laws last year. He also received a severence package (unknown value) late last year. I have been trying to have the amount of support raised for over a year now and he keeps dragging his feet. What is the probability that his kids can get some of this ''non-salary'' money?

Re: Child Support and gifts/severence pay.
the gifts are his separate property. The severance pay is income, but that came under the decree as it exists now, so you probably wouldn't be able to get any of it. If his regular NET income goes up, you have to go back to court to modify the decree.
