Child Support

My husband is currently paying child support for his tree year old son. The mother of the child keeps threatening to take him back to court to get an increase in child support even though she lives at home with her parents and does not work. How often can the amount he pays in child support increase and is there a maximum percentage they can take out of his check each month. The child support payments started coming out of his check in July of 2006.

Where she lives and whether or not she works is not a factor in child support. If there are no other children supported by your husband, the family code allows 20% of his net available resources (usually his gross pay less the tax deduction for one person) to be deducted from his paycheck.
