Child Support
My husband pays child support on his 11 yr old daughter. We just had two babies one in 2007 and then another one in 2008. Will his child support be reduced because of this. She is planning on taking us back to court to get more child support and she already gets a huge chunk of his pay right now. I don't mind him paying his child support because it is owed to that child, but what rights do my children have? Will it be reduced because of my two children or can she take us back to get more?

Although your husband has a reason for a revision of child support, perhaps his former wife is aware of any increase in his pay. If that is so, your husband needs a law firm capable of protecting him and your children.

Child support does not automatically raise or lower depending upon circumstances. Only the Court can officially change/modify the child support amount. I am guessing that your husband was initially ordered to pay an amont equivalent to 20% of his net monthly resources. Now that the two of you have had two children, the percentage will drop to 16%.
