child support

My ex husband hasnt pd child support in a year now. I have applied with the attny general office, but my case is still in assestment phase.

My ex husband states he doesnt pay is because my oldest son now lives with him for the past 2 years and he pays everything for him(car, gas, money, food, living, college, etc.) And now my other two go to his house every weekend instead of every other. Does this entitle him to NOT pay child support?

If your oldest son is over 18, then where he lives and what your EX pays is irrelevant. The fact that your other sons are over there every weekend is also irrelevant. Your EX still owes child support for the oldest son for the time before he was 18 and for the other children because the Order says so. The AG has 10's of 1,000's of these cases - probably 1,000's in your area, so they cannot be responsive to your immediate needs. The only good thing is the child support arrears continues to accrue with interest, so when they hit him, it will be a significant punch. Good Luck.
