My ex husband has raised my 4 year old son along with our 3 other sons. We have been divorced for almost 3 years and he continues to raise him, pays child support and takes him like his own. He is on the birth certificate even. Now he is in financial hardship and wants to disclaim him. Telling me I have to pay him child support back. Plus he doesnt want to have anything to do with him...which will devastate my son (who worships his father). What are my legal options in this case. He is not the best father..hardly ever pays child support. in fact he is 21K behind. Will my sons birth certificate have to be changed? I have actually let him claim two children on his income tax for every year so i will go towards his back child support. I think i have reimbursed him enough. Plus i gave him 200 dollars a month back out of child support for six month or so..until he quit paying altogether. I am just wanting to know my right. Please help me.

If he has filed an AOP, and listed himself on the child's birth certificate, and agreed to a court order for child support; depending upon how long ago this happened, it may be too late for him to complain now.
Regardless of the paternity of this 4th child, he is obligated to pay support, and you need to file an Enforcement, and possibly a modification action, to get those deductions back.
