Child Support

My husbands x wife had their son taken away from her when she went to prison for drug use & the state put him in foster care. We paid child support to her the whole 4 years he was in the care of the stste. Shouldn't the state have gotten the $ or us not paid anything? She was still getting all of it. Is there anything we can do to get the money back or at least get her to pay the state back if that's where it should have went?

Also the son is now living with us and we are still paying her child support. What do we need to do to get custody switched to us and make her start paying child support?

Clearly, your husband needed a lawyer a long time ago.

He needs to file a Petition to Modify (which will include a request for termination). He needs to hire a lawyer to legalize this arrangement, terminate his support, and order her support.
