Child support

If an illegal couple were married and divorced in Mexico and it was a mutually agreed divorce and no child support was assessed. Can one or the other parties now file here in the United States for child support, even if they are here illegally and the children were born in Mexico.

Re: Child support

Legal status in the U.S. nor the citizenship of the childen is not a factor for the determination of child support. There is no mention in the law nor the intent that child support is only for U.S. born children.
