Legal Question in Family Law in Texas

Child support increase

I make 14,000 a year as a teachers aide. Over the past 10 yrs I have taken my x back to court 3 times to raise child support. The first time he submitted an altered pay stub. (his x wife told me that the secretary of the company fixed it and then they started putting all his overtime on a check in x wifes name.(she will testify) I called the Attoney General's Office for years and finally had it raised to 650.00. It should have been 1250.00 but they said he paid 300 monthly child care. My kids have never been in day care. Again I called for over a year and nothing was done. X-wife calls me and told me he made 529,000 last year, usually he makes 80,000. I hired a lawyer and went to court in January. They told me we had to wait to see how he filed his tax return. After 9 months we go back to court and 280,00 is capital gains and 232,000 is wages, but he testified he only makes 80,000 and the other was a bonus. My attorney told me any bonus money and interest on his 242,000 in the bank and it would be used to calculate child support, but the judge reduce my support instead of raising it. I want to file an appeal, but I don't have the money. This decision has left me so depressed, I just want to give up on life. Been Cheated!

Re: Child support increase

If your account of the hearing is accurate, it is inconceivable that the judge had uncontroverted evidence of at least $232,000 in income, but reduced your child support from $650.00 monthly. As you are probably aware, there are serious deadlines in appellate matters, and although you are very frustrated with the system, you really need to consider appealing this matter. You may qualify for indigency, which will allow at least a waiver of the costs.
