Child support on a child in jail

I am wanting to know if you are paying child support and your child goes to prison while living with the custodial parent do you still have to pay child support?

Yes, assuming there is no provision in the decree to the contrary, and it is not a standard provision.

If the child will be absent for only a short time, it is not financially viable to go back to court. If it the child will be gone for an extended time, then it may be worth your while to ask for a modification of child support. The court may order that it be paid to the State instead.

The parent may have been ordered to pay attorney fees and court costs, and your child support is assisting in those costs.
