Legal Question in Family Law in Texas
Child Support Lien
My husband went to court on September 4th and he signed a court order to pay child support which included back child support of about $3700.00. He recieved a letter yesterday that was titled Child Support Lien. I am assuming it is because we own .25 acre of land that we are building a house on. What exactly does this mean? How long will the lien be in effect? Thanks for your help but he is worried that they are trying to take our land from us.

Re: Child Support Lien
The lien will last until the support is paid. It cannot be used to obtain a homestead, but since you don't live there yet, I assume that this is not yet your homestead. It also cannot be used against your interest in the property.
The first question that I see is whether you have a prior purchase lien or a construction loan on the property. If so, they will be "first in line". You will not likely be able to obtain any other loan until the lien is cleared.
You should see an attorney about this before you do anything else.
