Child support

I have been married 31 yrs and have 2 minor children living with me. My husband gets $2677.00 from a 100% service connected disability from the VA. My husband says that this disability can not be counted towards child support. Is this true and if it is how am I supposed to get support for my children? I would appreciate any help you can give me in this matter.

Section 154.062 of the Texas Family Code defines net resources.

If this is his only source of income, then his child support will be based on his monthly net resources.

If he gets disability plus has a job, you should still get child support based on his total income including all other income actually being received.

Child support is calculated from all available resources (with few exceptions). To answer your question, his disability income would be counted in calculating your support. Call me if you have any further questions or need to pursue a divorce.
