Legal Question in Family Law in Texas

Child Support Modification

I have been divorced for a year and a half. I now have a new wife and son. My salary has decreased over the last couple of years. I am aware that I am able to modify my child support due to the changes in my life now. My ex-wife informed me that she will drag it out as long as she can (possibly a year or more). Can she legally drag it out before it goes to court? And if so, for how long? And, is there any way to stop her from doing this? I know she will never agree to any decreased amount. I live in Texas, if that helps to answer. Thank you.

Re: Child Support Modification

I assume that your divorce was in Texas.

In your pleading for a modification, you can ask that the reduction take effect the date of the filing of the document.

Good luck!
