Legal Question in Family Law in Texas
Child Support Modification?
Husband pays $1350/mo in CS for 2 kids, age 5 and 10. We had a child last year. Husband makes about $10,000 more than he did when the CS was originally ordered. Ex-wife is custodial parent. She is not remarried, has never worked, and recieves supplemental income from her parents (about $200/week). **Therefore, we are providing the majority of HER standard of living.** Do you think we have a shot at having the CS modified to a more reasonable amount?

Re: Child Support Modification?
Slim to none -- in fact it might get increased.
It is the standard of living of the children. Moreover, the judge will remind him that he had an obligation to support these two children, before he made a decision to have another child.
In this day and age, the children's resources of $2150 per month are probably just enough to get by.
