Legal Question in Family Law in Texas
child support modification
I was laid off last year and now have a lower paying job. ''Pro Se'' I asked the court to modify my CS to a lower amt while I looked for a higher paying job - it was granted. Now the EX is taking me back to court saying I am intentionally underemployed. I have been searching for a higher paying job but right now the IT market in my area is not too good. I have done some research but need some guidance for the following -
1. what forms/procedures do I need to follow to call witnesses for the hearing
2. can I submit a Motion for Dismisal For Want Of Prosecution including my evidence/affidavits proving I have been looking for more lucrative work?
3. can my current spouse's income be used to determine my CS

Re: child support modification
Forms and procedures to call witnesses, well forms can be had from the clerk if you need subpoenas issued. Procedures to have testimony admitted is something learned during three years of law school and at least five years of trial work after that! This is the time to get a lawyer.
I am in your area.
