Legal Question in Family Law in Texas

Child support modification and visitation

My daughter is 15 and lives with her mother. She is supposed to visit with me every other weekend, but due to her age and social life I haven't enforced the visitation. I haven't seen or talked to her since her birthday (January) and today was served with papers requesting an increase in child support and modification to visitation. I--name removed--t mind paying more if I need to, but can I ask the judge to enforce her visitation? I--name removed--t think it's fair that I never see her or talk to her. Each time I ask her to come visit she has other plans and when I call even though she has caller ID she never calls me back, her mother doesn't encourage her to come see me or call me and yet she wants more money and wants to modify visitation. Can she ask for more money and yet I still--name removed--t get to see my daughter?

Re: Child support modification and visitation

These are 2 separate issues.

She can get more child support and you get no visitation.

If you want to enforce visitation with contempt, you need to make an effort to pick up the child and no be able to do so.

You are free to file contempt against her for not following the visitation schedule.

I hope this is helpful.

Good luck!
