Legal Question in Family Law in Texas

child support for non established child

my husband is paying child support since early 90's where parternity has never been established through DNA. He contested in court in the beginning of order. he has not seen the child (dob 04/85) or mother since 1987. he paid for DNA test and child, now adult never showed for testing. Can we sue through court to establish paternity if proved he is not the biological father can a motion be filed to dismiss child support? We are looking for an attorney that specializes in these cases. The DNA facility offered free testing for the child/adult if we get a court order.

Re: child support for non established child

I'm not really sure what you are asking.

Paternity does NOT need to be established with DNA.

If you want to call me next week at 713-847-6000 perhaps I can answer your question.

You can also email me direct at [email protected] with more details. Such as county of continuing jurisdiction, court number, and what the order said regarding child support. In the order was he "found to be the father of the minor child"?
