Legal Question in Family Law in Texas

Child support order withholding

Which attorney (party) is responsible for filing the wage withholding order to the employer?

Is there a legal responsibility or a standard practice between attorneys? I thought that the petitioner who sued for additional child support and was awarded it was then responsible for filing with my employer (I gave them all the info).

Re: Child support order withholding

While generally the person who is going to get the child support has a vested interest in seeing that the WWO goes to your employer, the responsibility for paying your child support lies totally on you. Unless and until the child support is actually being taken out of your wages, it is YOUR responsibility to see that your child support obligation is paid and paid on time. Since you are the one who is facing jail time if your child support is not paid, making sure your employer has a copy of the WWO is ultimately in your best interest. Your ex not serving a copy of the WWO on your employer does not in any way get you off the hook for paying that child support.
