Legal Question in Family Law in Texas

Child support over-payment

Husband recently starting having child support taken out of his paycheck, until which time he paid on his own (for 10 years). He made a payment a week early (due on June 1st) and then company started taking payments from paycheck the first week of June. (He paid $252.50 2x a month on his own; Company pays $116.54 weekly) He is now ahead by $252.50. Can he ask the employer to not take out 2 weeks of payments or can this over payment be applied to medical expense reimbursements due to his daughter's mother? or is just a loss???

Re: Child support over-payment

He may apply to the court to terminate the child support with holding order when it should be terminated. He should make this request in advance of the time it terminates and then present it at the end for the judge's signature. In the meantime, he will always be a month ahead which could be helpful in the event he ever lost time from work. You might wish to discuss this with the child support office which handles the checks.
