Legal Question in Family Law in Texas

child support

My ex has never paid child support. We are in the process of trying to collect. I was told by the Attorney gernerals office that he has applied for SS disability. I asked if he were to die and he had be recieving benefit who would collect? I was told my child would. Is there any thing I can do to collect any amount of money that I have spent on her, and colleage fees that he would pay? basically is there any money that I could ever get from him or am i SOL. Can I put a lien on anything?

Re: child support

You can get 1/2 of his SS check. That ought to put him under the bridge. Good Luck.

Re: child support

I'm not sure I read your question exactly the same as Mr. Grissom. I don't know of anyway you can get anything for college that you haven't paid for yet, especially since that isn't something that can be ordered by statute. If in your decree/order child support is an obligation of his estate you could have a claim against the estate for child support until your daughter ages out.

Depending on the type of disability your ex may eventually qualify for, your minor daughter might also get her own benefits which would come to you. Even if the type of disability he eventually gets doesn't allow for separate benefits for your daughter, child support can be taken out of disability payments. If he dies, your daughter might get an "orphans benefit" because of his death (not his disability) but the checks still would come to you.
