I am getting a divorce which was suppose to be uncontested. I have a 12yr. old who does not have my soon to be ex last name but who raised her since she was 1 and 1/2 yrs old. I filed with her included hence child support is included. Now he changed his mind and do not want her included in the decreed. The original petition states her as our child. The lawyer said that it cannot be changed and the choices he gave me was to sign a paper as to her not been his and then he'll get a citation where he has to deny paternity. He does not want to do this. What other suggestions can I have? I live in Texas. She does not know other father and personally I dont know where the biological father is. Please help.

I disagree that the original Petition cannot be changed.
Get a second legal opinion from another domestic relations attorney in your town.
